The rates present on this website correspond to the prices that will be applied on our website and in the app, there being no significant difference in the amounts for contracting services on the website or app online.

Object.

The purpose of these conditions is to regulate the contracting relationship for the rental service of electric bicycles and Personal MOBILITY VEHICLES (VPM) ELECTRIC SCOOTERS, created between COYOTE EIVISSA S.L, and the user at the time he accepts, during the registration process, online contracting, the corresponding box. The contractual contracting relationship entails the temporary rental, in exchange for a determined price and publicly displayed through the website, of a specific model of electric bicycle and/or scooter.

General information.

Both parties attest to these general contracting conditions, except for special conditions agreed with each particular client.

Rental service contracting procedure.

The rental service contracting procedure may be carried out in Spanish and English. The prices and delivery conditions on this website will be applied in national territory and in compliance with Spanish legislation, since the contracting is carried out in Spain. The currency used exclusively will be the Euro. The user must register on the website to access the bicycle rental service offered by COYOTE EIVISSA S.L.

First, select the desired bicycle or scooter model by clicking on it. The user must indicate the delivery and collection location, as well as the time in each case. The request can be confirmed by clicking on "CONTINUE". A summary of the request will then be provided in which the user will be informed of the details of the reservation, as well as the bicycles and/or scooters selected. In this step of the contract, the user will be able to increase the number of bicycles and/or scooters. To confirm the request you must click on "CONTINUE". The platform will offer the user a table with all the selected contracting and its total amount, also indicating the amount corresponding to the required deposit. Once the data has been reviewed, the user will be able to access their account by indicating their email address or by creating a new account. The platform will ask you for your contact information and the desired payment method. The hiring request will be confirmed by clicking on "CONFIRM".

Once the reservation is formalized, the platform will automatically give the user a reservation code and send an invoice for the rental service to the email provided. The data provided will be stored for future contracts, indicating the email address or username and password. All COYOTE EIVISSA S.L., in accordance with the indicated privacy policy will guarantee the confidentiality of your data.

Order delivery.

The delivery of the rented bicycle will be made at the selected site by the user and that is available and offered on the platform. Likewise, the time for delivery will also be established according to the user's own choice.

The platform is designed so that only the hiring of those bicycle models that are available in the app or on the website selected by the user and that is available can be confirmed. However, if due to any technical failure in the platform or app, an unavailable model could be contracted, COYOTE EIVISSA S.L, undertakes to inform the user as soon as possible of this lack of availability and by virtue of Royal Legislative Decree 1/2007, of November 16, which approves the Revised Text of the General Law for the Defense of Consumers and Users, the client must be able to recover as soon as possible, and in any case within a maximum period of 30 days, the sums paid for the rental.

Likewise, if the model contracted for rental is not available, when the user has been expressly informed of such possibility, COYOTE EIVISSA S.L. may supply, without a price increase, a model of bicycle and/or scooter with similar characteristics that has the same or higher quality.

Price.

The price of the products will be the one that appears in the description of the products in which the Value Added Tax (VAT) is already included. Therefore, the final price of the product is indicated.

Each model will require an economic delivery in the form of a deposit that will be made directly at the store where the bicycle is picked up. This amount will be fully returned to the user at the time of returning the bicycle, as long as it is in perfect condition.
The client assumes that in any case the economic valuation of some of the products may vary in real time. In any case, this will always be previously communicated to users.

Payment Methods.

During the contracting process, the payment method desired by the client will be selected from the four available:

Paypal: The server will redirect you to your Paypal account to make the payment.

Bank transfer: Where the amount of the services is paid in advance into a bank account provided during the processing of the rental service contract. Orders placed via bank transfer will be active in our system for 12 hours. Telephone payment: Through the telephone +34 971 253 610.

Payment upon delivery: For this modality, a credit card number will be required to formalize the contracting of the service.

Finally, the data provided will be verified and the desired order will be confirmed. From that moment on, an e-mail will be received from the provider where it will also be certified that the contract has been made.

Cancellation of the service contract.

You can cancel the service contract at any time. This cancellation will be free as long as it is made 5 or more days before the day selected for delivery. The refund of the cancellation will be made using the same method with which said payment was paid. In those cases in which the cancellation occurs with less notice, the cost will be 50% per bicycle and/or scooter reserved for rental.

Rental Terms and Conditions:

The person renting must be over 18 years of age and will be responsible for the rented equipment. He must also have a National Identity Document or Passport. The contract holder is responsible for the rented equipment.

The lessee declares to be in perfect health, to be able to handle a bicycle and to have the necessary control of the rented equipment.

The client who rents any equipment owned by COYOTE EIVISSA S.L is subject to the following terms and conditions of contract:

1. The duration of the lease will be that stipulated by COYOTE EIVISSA S.L. and the client, and will be reflected in the specific conditions of the contract that is signed.
2. The bicycle and/or scooter must be returned on the date and place specified in the contract.
3. Failure to comply with the delivery time will cause an additional cost to the client of 8 euros per hour or fraction of an hour of delay. If the material is not delivered on the same day stipulated in the contract, the additional cost incurred will be 60 euros for full-day rental.
4. The lessor may unilaterally terminate the rental contract before the date of its conclusion in the event of serious non-compliance by the lessee in the use and care of the bicycle and/or scooter. In this case, the lessor may take immediate possession of the bicycle and/or scooter in the place where it is located, without the lessee having the right to any type of claim or compensation.
5. The lessee may extend the duration of the rental of the bicycle and/or scooter as well as the material, provided that their availability allows it, by communicating it electronically or by email info@coyotemobility.com of the lessor where the lease was formalized, before its termination date. In this case, if the landlord so requires, a new contract must be formalized.
6. Upon expiration of the contract, the lessee must deliver the bicycle and/or scooter to the place designated in the rental contract. If the lessor does not do so, he or she may immediately take possession of the bicycle and/or scooter in the place where it is located, without having the right to make any claim on the part of the lessee.
7. Cancellations must be made with a minimum of 24 hours from the date of the reservation, outside of this period the rental amount will not be refunded.
8. The bicycle/s, scooters and material are delivered in perfect conditions of use, with all their tools, accessories and equipment, in perfect condition, and must be returned by the lessee in the same conditions.
9. The lessee may not assign, sell, mortgage, exchange or pledge the bicycle, scooter or accessories or their tools and elements. In no case will he use the bicycle, scooter or accessory in a way that conflicts with the property rights of the lessor.
10. It is prohibited to make any type of modification to the bicycle, scooter or accessory without the written consent of the lessor. It is also prohibited:
– Put the bicycle, scooter in the sand on the beach, as well as submerge it in water, since the damage that the bicycle, scooter and batteries may suffer could be irreparable.
– That other people who are not designated as users in the rental contract use the bicycle, scooter and rental equipment.
– That the bicycle, scooter is used in competitions or similar, whether official, sports or without a competitive nature under any circumstances.
11. Likewise, use on sports or similar circuits is also prohibited.
12. Any off-road motorcycle is prohibited. They must travel on paved roads. If it is going to be used off-road, a signed consent from COYOTE EIVISSA S.L will be required, so the reason why it is going to be used off-road must be informed at all times.
13. The lessee will be responsible for the good care of the set of keys, the basket, the lock, helmet and any other material delivered, if any. In case of loss, the lessee will be responsible for the cost, according to the market price, of the material.
14. The leasing company is not responsible for possible losses or theft of the bicycle(s), as well as the rented material, and the amount corresponding to their restitution must be borne by the lessee.
In the event of loss or theft of the bicycle, the lessor will lose all right to the deposit and must immediately notify such circumstance.
15. The lessee expressly undertakes to pay the lessor the charges that correspond to the prices of the established rates, which will be stipulated in the specific conditions of this rental contract, taking into account the model of bicycle and scooter, at the time of disposal of the bicycle and the legally applicable taxes, as well as the accessory materials, which in any case are rented.
16. The following will also be the responsibility of the tenant:
- The amount or difference in value of the tool or other tool that is missing from the bicycle or has been replaced.
– Expenses incurred by the lessor for transportation and cessation of the bicycle.
– The amount of all types of fines, judicial and extrajudicial expenses derived from any type of sanction, including tow truck and municipal deposit expenses to remove the bicycle, for events that occurred during the term of the contract.
17. Likewise, all legal expenses arising from non-compliance by the lessee with the obligations established in the lease contract will be borne by the lessee.
18. Bicycle rental does not include damage insurance, so the renter is responsible for all material or personal damage that he or she may suffer. The rental is carried out with the coverage of the corresponding liability insurance that covers all damages caused by the rental to third parties, people or property.

REMINDER TO LESSEES OF THE TRAFFIC REGULATIONS APPLICABLE TO BICYCLES AND SCOOTERS WHICH THEY MUST COMPLY WITH.
 
• For bicycles:
Wear only a helmet on interurban roads and on highways. (Always being mandatory if you are under 16 years old).

• For Scooters:
A) The use of a helmet is always mandatory on the VMP scooter (Personal Mobility Vehicle). Among them, they must always circulate on public roads, they can never circulate on sidewalks, pedestrian areas, crossings, highways, highways, interurban roads or tunnels. in urban areas.
B) For both mobility systems. (Scooter and Bicycles).
C) The use of headphones or music headphones and mobile phones when driving is prohibited.
D) Always circulate on public roads.
E) It is not allowed to circulate under the influence of alcohol or drugs, only one person can be transported, they must wear reflective clothing at night or with reduced visibility.
F) It is recommended that any signaling must be done when making maneuvers, turns or changes of direction.
G) Please note that any non-compliance with traffic regulations or municipal ordinances of the locality where it is circulated will be the sole responsibility of the tenant user.
H) Leave vehicles parked in spaces designated for this purpose.
 
Applicable guarantees and property reservation clause.

All models and materials offered through the website are completely original, unless otherwise indicated in their description.

All of them have a guarantee period, in accordance with the criteria and conditions described in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.
Applicable law and jurisdiction.

These conditions will be governed or interpreted in accordance with Spanish legislation in that which is not expressly established. The provider and the user agree to submit any controversy that may arise from the provision of the products or services subject to these Conditions, to the Courts and Tribunals of the city of Ibiza (Spain).
